We use the information we collect about you to assist in the conclusion of transactions and to provide a more personalised auction experience. Please read on for more details.
What does our privacy policy tell you?
- Information provided by you on registration:
Our registration form may require you to give us contact details (like your name, address, phone number(s) and email address) and billing information (such as credit card details) in order to participate in the relevant QXL Service. You have the opportunity to supplement or change this information after you have registered. Although you can choose not to provide certain information, this may limit your use of some of the features of the QXL Service.
- Your preferences:
You may be asked to specify whether you wish, or do not wish, to receive marketing, promotional or other communications from QXL, businesses with which we have established a commercial or marketing partnering relationship (such as sites with which QXL has co-branded), or other third parties.
- Transactions you enter into:
We may retain information about the Transactions you enter into through the QXL Service, including the price paid, the goods or services purchased/sold, the method of payment, together with related contact and billing information.
- Information gathered from your use of QXL Services:
We may
We may gather various types of information about your use of QXL Services, such as:-
browser type (e.g. Navigator, Internet Explorer), operating system (e.g. Macintosh, Windows), IP address and Internet domain (e.g. Demon, Wanadoo, AOL, or one of sites with which QXL has co-branded) through which you access QXL Services;
information produced by cookies, which enable our systems to recognise your computer and allow us to see how you use our site. Remember that most browsers allow you to stop receiving cookies if you want. For example, in an Internet Explorer browser, you can do this under "Internet Options" in the "Tools" drop-down menu.
- Information gathered from surveys:
Our occasional surveys ask visitors for demographic information (like their postal code, age, or income level).
- Information gathered from contests:
We occasionally run contests on QXL Services, in which entrants may be required to provide personal, contact and demographic information.
- Your communications to us:
We may retain emails, text messages and letters sent, and may record phone calls made, to QXL.

2. How do we use this
information? |

- Contact and billing information provided by you:
- We may check the accuracy and validity of the credit card details, address and other information you provide to us on registration; your registration for and use of our service is contingent upon those checks being successfully completed. But remember, registration itself is free;
- We may use information you provide on the registration form for accounting purposes;
- We may use contact information (such as address, email address, phone number and fax number) you provide to us for making contact with you when necessary (for example, to respond to your queries or for other customer service issues)
- We may use that contact information to provide services that you have specified (such as where you have taken out SMS/text messaging alert service) or to send you information about QXL and its services. You may opt-out of receiving future mailings from QXL at any time; see the delete/deactivate section below.
- If you register to receive newsletters or other information from us by email, then QXL will use the email address you have provided to us to send the newsletters or information you have registered to receive; you can change the email address we hold for you on your "My Account" page when you are logged in to the QXL Service. You may opt-out of receiving future newsletters and/or other information you have registered to receive from QXL at any time; see the delist/deactivate section below.
- Your preferences: We use this information to determine what, if any, of the personal information we gather and track concerning you we are entitled to disclose outside QXL, and for what purpose, and what limitations there are upon our use of your contact data.
- Transactional information: We may retain details of transactions entered into through QXL Services for the purposes of our records.
- Information gathered from your use of QXL Services:We may track the areas of the QXL Services you visit to see what interests you in particular, which site you accessed the relevant QXL Service from, and leave that QXL Service to visit next.
- Demographic and profile data: This information may be used to tailor your and/or others' experience of QXL Services, showing content that we think might be of interest, and displaying content according to any explicit or implicit preferences.
- Survey Information: We will hold and use survey information you contribute to improve our service to you and others, and will only supply it to others on an aggregated, anonymised basis.
- Contest information: We may use any information you provide to us to contact you when necessary (with a winner's notification, for example). If you enter one of our contests and opt to allow us to do so, we will add your personal data to our database (including our mailing list for future contests); that personal data will be used and protected in accordance with this policy. Contest entrants may opt-out at any time of receiving future mailings; see the delete/deactivate section below. If you are a contest winner, your name or the user-name you use on our service may be used on the contest winners' page of the relevant QXL Service for a limited period, to show that you were successful.
- Your communications to us: Emails, letters, phone calls and text messages may be used for testimonial purposes on QXL Services and for the purposes of our records, but will be withdrawn within a reasonable period if we are requested to do so; see the delete/deactivate section below. We will identify you only by your QXL user-name.

3. Sharing of information |

We do not sell, share, trade or give away personal information about you other than as described in this Privacy Policy.
- Companies in our group: We may share data provided, gathered and tracked about you with our subsidiaries and other companies in our group, but only for the purposes described in this Privacy Policy.
- Parties to transactions: Where you use a QXL Service to enter into a transaction with another company or person, we may provide contact and billing information supplied by you (or collected about you) to that other party in order to facilitate the transaction, or correspondence concerning that transaction.
- Our commercial and marketing partners: We may share data provided, gathered and tracked about you, including information about transactions you have entered into (but, in any event, excluding your billing information) with specific commercial and marketing partners (for example, businesses with which QXL has co-branded the QXL Service) if you have opted to authorise this when asked to do so on-screen. The use made by the disclosee business of your data will be governed by their own privacy and related terms. We may also disclose aggregated demographic and profile data (in which neither you nor any other individual is identified) to our commercial and marketing partners.
- Other third parties: We may also disclose your contact information to selected third party suppliers of goods and services and advertisers, who may use it to market to you their products and services, if you have opted to permit this kind of disclosure. For guidance on how to change your options, see the delist/deactivate section below.
- Changes in QXL's business: If all of the assets which QXL uses to operate its business (or substantially all of them) are acquired by a third party, we may transfer personal data we then hold to that party. In the unlikely event that an insolvency practitioner (such as a liquidator) is appointed in respect of QXL's business, that practitioner may sell, trade or rent personal data we then hold.
- Overseas transfers: QXL is the controller of the personal data we gather about you. Your data will be held and processed by us in accordance with our obligations under the UK's data protection legislation - specifically, the Data Protection Act 1998 - either in the UK or in other countries where we are legitimately permitted to do so. Where required for the purpose of QXL's business and to enable us to offer you goods and services from around the world, your data may be transferred to any country in the world for the purposes described in this Privacy Policy - and always in conformance with our obligations under the relevant legislation. Countries outside the European Union may not have as well developed data protection laws in place to protect your information as those inside the EU, but we will nevertheless ensure your personal data is treated in compliance with those laws and this Privacy Policy.
- Disclosure for legal reasons: We may disclose your personal data if we are either compelled to do so by law, or in response to a valid, legally-compliant request by a law enforcement or governmental authority.

4. Security |

We have security measures in place to protect our customer database and access to this database is restricted internally. However, it remains each Member's responsibility:
- To protect against unauthorised access to their "My Account" details on the QXL Service;
- To ensure no-one else uses the QXL Service on that Member's machine while it is "logged on" to the QXL Service;
- To log off or exit from the QXL Service when not using it; and
- To keep his/her password secret.
- We use a secure Stronghold server with state-of-the-art encryption and secure sockets layer (SSL) technology for the transfer of credit card information. QXL also has a digital certificate authenticated by Verisign. If you do not have a secure browser or do not wish to send your credit card details over the web using a secure browser, you are welcome to open an account by fax or phone.
- We have security measures in place to protect our customer database and access to this database is restricted internally.

5. What delist/deactivate choices do you
have? |

QXL provides the following additional opportunities for updating us about your preferences, for example that you do not want in future to receive by email from us, or want to remove your registration details entirely from the QXL Service:
